Is it a legal requirement?
Not always. You don't legally have to engage a party wall surveyor just because you're building near a boundary. You do have to follow the procedures in the Party Wall etc. Act 1996 if your work falls within it. If your neighbour dissents, or doesn't respond to your notice, appointing a surveyor becomes a legal necessity, because only surveyors can make the award that resolves the dispute.
